General Terms and Conditions

Presentation

monchauffeurprivéparis.com is a transportation service, a limited liability company with a capital of €1,500, whose head office is located at 169, Avenue du Général de Gaulle, 91150 Paray Vieille Poste, France, and registered in the register of commerce and companies of Essonne, France, under the number 90443843900013 (hereafter "the Company"). Intracommunity VAT number: FR95904438439.

The Company provides a chauffeur-driven car service (the “Service”) that operates exclusively on immediate or advance reservations (the “Reservation”).

These General Terms and Conditions (“GTC”) constitute the contract through which the Company offers and provides the Service and they apply to all vehicle reservations, placed by the Customer (the “Customer”) with the Company, either by telephone or via their Site www.monchauffeurpriveparis.com.

By using the Service, the Customer acknowledges and accepts all the terms in the GTC.

Purpose of the Service

The Company provides a transportation service and provides its Customers chauffeur-driven vehicles. The Company is registered in the register of the operators of tourism cars, with Driver, under the number EVTC 092180063 and subjected to the provisions of the articles L231-1 to L231-4 of the code of tourism and the decree n°85-891 of August 16, 1985.

Reserve a vehicle

The Customer is informed that all vehicles provided on the Site range from sedan to van.

The location is open every day, 24 hours a day and is only accessible by reservation.

Prerequisites

Any Reservation made via the Site is subject to prior acceptance by the Customer of the present General Terms and Conditions.

Different steps to make a Reservation

To make a Reservation, the Customer connects to the Site by entering his Reservation information. He/she fills in the various fields relating to the desired trip (address of departure, address of destination, type of car). If the address of departure or destination is not filled in, the reservation process cannot be completed. If a destination is entered, the Company will propose a price for the requested trip.

The Customer is free to accept or not the offer proposed by the Company; if he accepts the offer, the Customer must have previously made sure that all the information displayed on the Reservation page is in accordance with the desired trip.

The Company shall transmit the Reservation to the driver (the “Driver”) who will be in charge of the reserved trip.

Once all the necessary information has been forwarded, the Customer is required to pay for the trip by credit card.

Advance Reservations

The Customer may reserve a vehicle with the Company in advance of the requested departure date. The Customer may reserve maximum 1 (one) month in advance and minimum 30 (thirty) minutes before the scheduled departure time. The Customer shall indicate the date, time and address of departure, any intermediate stages and the final point of arrival, any other particularities concerning the trip (additional indication of the meeting place, etc.), as well as the name and surname of the passenger. Depending on the number of Reservations already placed for the chosen date and time, the Company reserves the right to refuse additional advance Reservations.

The Company registers the Reservation and, upon receipt of the request, proceeds to a vehicle search corresponding to the Customer’s wishes, without making an immediate reservation of a vehicle. The final vehicle search is carried out within one (1) hour before the scheduled departure time, depending on the address of departure and local traffic conditions.

Reservation from an airport

When making a Reservation, the Customer must specify the airport, the date of the trip, and the flight number. The expected time of landing as well as the arrival terminal, which can be modified by the flight conditions and the airport administration, may also be indicated but are not contractual. The Company cannot be held responsible for any erroneous information provided by the Customer (incomplete flight number, date error), nor for any erroneous information regarding the reference flight for the trip, provided by the airport's information service.

The Service of the Company includes 1 (one) hour and 15 (fifteen) minutes of free waiting time at time of arrival of the flight.

Beyond this free waiting time, the Company will charge the Customer an airport waiting fee of €30. Please refer to paragraph “Waiting Fee” for additional information.

Reservation by phone

A telephone reservation service is available 24 hours a day, 7 days a week, by calling a local phone number (cost of a local call from a landline telephone). 

Reservation through the Site

The Customer can place a Reservation online, via the Site www.monchauffeurpriveparis.com. The online Reservation is redirected to a secure Mypos-site. This transfer will not cause any additional fees charged by the Company to the Customer, unless complementary unforeseen fees (e.g., waiting fees) are due.

Customer's obligations

After validation of the Reservation, the Customer must be present at the agreed location address, scheduled date and time. The Customer will receive an email and/or a text message to confirm the appointment. In case of a late arrival of more than 10 (ten) minutes by the Customer, a waiting fee, as determined in paragraph “Waiting Fee” of these GTC, will be automatically charged to the Customer. In case of a late arrival of more than 15 (fifteen) minutes, the Driver is deemed to be free to leave. The Customer agrees to behave on board the vehicle as a "good father". In the event of damage to the equipment and/or to the vehicle, attributable to the Customer and/or the passengers, the Company will charge the Customer for the cost of repairing the vehicle or changing the equipment. Passengers, adults and children, are obliged to wear their seat belts. A fine is incurred for each person caught in default, at time of control by the forces of law and order. For safety reasons, smoking and the transportation of flammable, explosive, corrosive or toxic substances are prohibited. Failure to comply with this stipulation will engage the responsibility of the Customer and the passengers. The Company reserves the right to take any action it deems necessary. Luggage must be placed in the trunk of the vehicle. Luggage remains under the full responsibility of the Customer. No luggage can be entrusted to the Driver. The Driver may refuse luggage of excessive weight or size, as well as those that he considers detrimental to the safety of the transportation. Any modification of the estimate of the trip initially planned and paid in advance through the Site (waiting period, parking, additional stop, change of address...) will result in additional fees, directly charged to the Customer by the Driver.

Obligations of the Company

The Service set up by the Company consists of a search service for an available vehicle corresponding to the Customer's needs. The Company is thus bound by a simple obligation of means and makes every effort to find as quickly as possible an available vehicle for the Customer. Upon receipt of the Customer's request, at the condition that the destination is completed, the Company undertakes to propose an offer indicating the price of the journey. If the Customer accepts the offer, the Company undertakes to send the Customer a confirmation of the Reservation, either by e-mail or SMS.

Cancellation of the Reservation

All cancellation conditions are defined in these General Terms and Conditions. If the vehicle has already arrived at the place of departure at the time of cancellation, the amount will be fully due to the Company. If the Customer has not cancelled the reservation before arrival of the vehicle, and the Customer doesn’t show up at the place of departure, while the Driver or the Company has informed the Customer of the arrival of the reserved vehicle, the full amount of the ordered trip will be charged to the Customer. The Customer has the possibility to cancel the Reservation 3 (three) hours before the scheduled departure time of the trip. In this case, the full amount of the trip will be refunded. In any other case, the Customer is liable to pay the full amount of the trip to the Company.

Privacy / Personal data protection

The present General Terms and Conditions are subject to the provisions of the law n° 78-17 of January 6, 1978, relating to Data Processing, Data Files and Individual Liberties. The Customer has the right to access, rectify and delete personal data concerning him/her, upon written request, sent to the Company. The Company informs the Customer of the use made of the personal data, collected in the context of the use of the Site. The Company may communicate the Customer's contact details to third parties for the purposes of using the Site, in particular to the Driver. The Customer has the right to object (by any means, and in particular by letter sent to the Company) to the transfer of personal data to third parties for commercial prospecting purposes. The Customer agrees that the Company reserves the right to record and retain, for evidentiary purposes, all information relating to the connections made, such as data relating to the trips made and the personal details of the Customer.

Waiting fee

A waiting fee may be charged, as follows: Airport waiting fee: - 1 (one) hour and 15 (fifteen) minutes: included in the Service - beyond this waiting time: €30 Train Stations and other departures waiting fee: - sedan category: €12.50 per 15 minutes - van category: €15 per 15 minutes

Each 15-minute period started is due.

Payment

Payment can be made directly on the Site through the secure site Mypos, or directly to the Driver, either by credit card or in cash.

Issue of the invoice

Once the Reservation has been paid online and the Service has been completed, the Company sends the Customer an invoice to the email address he/she provided at the time of the Reservation.

Execution of the Reservation

The transfer starts when the Customer gets into the Driver's vehicle and ends when the Customer leaves the same vehicle.

Customer care

The Driver may refuse to pick up the Customer, if such refusal is the result of the Customer's behavior (drunkenness, presence of an animal weighing more than 8 kg and not placed in a cage, danger to the safety of the Driver and the vehicle, etc.) or from incorrect information provided by the Customer.

Quality commitment

Compliance with regulations

The Company undertakes to ensure that the Drivers and their vehicles comply with the regulations in force, related to operating tourism vehicles with drivers.

Insurance

The Company is guaranteed by a solvent insurance company that covers the risks related to its activity, in accordance with the legislation in force. Passengers are considered as third parties with respect to the Driver, and are covered for all bodily, material and immaterial damages that they may suffer, as a result of a traffic accident and this in an unlimited way for bodily damages, from the moment they get into the Vehicle until they leave the Vehicle, except for damages caused by the Customers’ or its passengers’ fault.

Claim

The Customer may address by registered letter with acknowledgement of receipt a claim to the Company at the following address: 169, Avenue du Général de Gaulle, 91150 Paray Vieille Poste, France.
